Users that have recently been banned from Xbox LIVE for their modded 360s may be retaliating thanks to a law firm called AbingtonIP.

Joystiq report that the law firm is describing Microsoft's actions as 'convenient' due to the fact that they were banned from LIVE only after they purchased a Gold level subscription.

According to AbingtonIP, the ban wasn't enacted until after games like Halo 3: ODST and Modern Warfare 2 were released. Whether or not this can be conclusively proven is hard to say.

The plaintiffs reward if they won would be reimbursement for subscription fees along with prorated fees for lost time.
